1. Acceptance of Terms
By placing an order with Ampersand Marketing Ltd, trading as Good Egg (hereafter referred to as “the Company”, “we”, “our” or “us”), including via our online store, you (“the customer,” “you”) agree to be bound by these Terms & Conditions. If you have a separate formal purchase agreement with Good Egg, that separate agreement will take precedence over these Terms & Conditions.
2. Formation of Contract
- Your order (online or otherwise) constitutes an offer to buy goods or services from us under these Terms & Conditions.
- Processing your payment or sending an order confirmation does not constitute acceptance of your offer.
- A binding contract is formed only once we dispatch the goods. We reserve the right to decline or cancel any order before dispatch.
3. Consumer Guarantees Act 1993
Non-Business (Consumer) Purchases
- If you are acquiring goods or services from us for personal, domestic, or household use, nothing in these Terms & Conditions is intended to limit or exclude your rights under the Consumer Guarantees Act 1993.
- In the event of any conflict between these Terms & Conditions and the CGA, the CGA will prevail.
Business Purchases (Contracting Out)
- If you are acquiring goods or services for a trade or business, you agree that the guarantees provided under the CGA do not apply.
- This contracting out is only effective if you are purchasing for business use.
4. Errors or Omissions
- We take every care to ensure the accuracy of pricing, stock levels, product descriptions, and other information on our website.
- If we discover an error (whether clerical, computational, or otherwise), we will notify you promptly.
- If we have inadvertently listed an incorrect price or the product is out of stock, you may choose to continue with any adjusted price or ETA, select an alternative product (subject to price differences), or cancel the order for a full refund.
5. Description of Goods
- We rely on information from suppliers and manufacturers to provide product descriptions, images, and specifications.
- If a product does not match its advertised description, please notify us.
- We are not obligated to supply a higher-priced product in place of an incorrectly described one.
6. Delivery of Goods
- Any stated delivery timeframes are estimates only; we are not liable for losses or damages arising from delivery delays.
- We may dispatch your order in one or more instalments.
- Goods are shipped via signature-required courier. If you request (or your address defaults to) a no-signature or shared-drop delivery (e.g., apartment lobby, mailroom, front door), we are not responsible for any subsequent loss or theft after the goods are marked delivered.
7. Out-of-Stock Products & Backorders
- If an item you ordered is found to be out of stock, we will:
- Place the item on backorder and provide an estimated time of arrival (ETA), or
- Offer an alternative item (subject to availability and price differences), or
- Provide a full refund if the estimated time before the item is available is too long or if no suitable alternative is available.
8. Returns, Refunds, and Replacements
8.1 Change of Mind or Non-Faulty Returns
- We generally do not accept returns simply because you no longer want the goods (“change of mind”). However, at our discretion, we may accept returns under the following conditions:
- Within 7 days of delivery:
- If the product is unopened, unused, and in original packaging, we may accept a return for full credit or refund.
- If the product has been opened but is unused and in re-saleable condition, we may accept a return subject to a restocking fee (see below).
- After 7 days but within 20 days of delivery:
- We may accept unopened goods at our discretion, typically with a 15% or $30 restocking fee (whichever is greater).
- If the packaging is open or the product is used, a 25–50% restocking fee may apply if we agree to accept the return.
- No returns will be accepted after 20 days for “change of mind,” unless we explicitly agree in special circumstances.
- Restocking Fee:
- The restocking fee may vary depending on product type and condition (minimum 15% or $30, whichever is greater).
- The restocking fee helps cover our processing costs and re-selling the item at a potential loss.
8.2 Faulty or Defective Products (Under Warranty or CGA)
- Hardware typically has a 1-year (or more) manufacturer’s warranty.
- Consumables (e.g., toner, ink) generally do not carry the same type of hardware warranty, but you may still have rights under the CGA if the items are defective or not as described.
- If you believe a product is faulty, please contact us. We will advise the appropriate next steps.
- Do not send items back to Good Egg. Return goods should be sent to our suppliers. Our instructions will include the shipping address and an RMA (Return Merchandise Authorisation) number.
- Do not return items without an RMA number.
- In many cases, Good Egg will manage the return and replacement with the distributor on your behalf.
Repair or Replacement
- If a product is determined to be faulty within its warranty period, the manufacturer will typically repair or replace it.
- If no suitable replacement is available and repair is not possible, a refund or suitable alternative may be offered.
8.3 Shipping Costs for Returns
- For faulty or incorrect items:
- If we supplied the wrong product or it is confirmed faulty, we will cover the reasonable cost of return shipping (or provide a courier label/pickup).
- For change-of-mind or non-faulty returns:
- You are responsible for the shipping costs to return the item.
- We will cover shipping back to you (if it’s being replaced) only if the returned item is confirmed faulty.
8.4 Return Process
- To request a return (faulty or otherwise), please contact us. Provide:
- Your order/invoice number
- Product details
- Reason for return
- We aim to respond within 1–3 business days with an RMA number and further instructions, but this may take longer depending on the warranty provider and the reason for return. Processing times can vary depending on the product, manufacturer, or distributor policies.
9. Warranties
- All our products are NZ-sourced, so warranties are supported within New Zealand.
- We sell printer cartridges for use in printers made for and purchased in New Zealand. If you own a printer manufactured for a different market, these cartridges are not guaranteed to work due to different firmware settings.
- If a product is obsolete or no longer stocked, we may need to wait for an overseas shipment or offer a suitable alternative or credit.
10. Seller’s Liability and Maintenance Guarantee
- Fit for Purpose:
- You must satisfy yourself that any goods are suitable for your intended purpose. However, if you are a consumer under the CGA and the product is not fit for the disclosed purpose or not of acceptable quality, you have the right to seek a remedy under the CGA.
- Manufacturer Guarantees:
- You are also entitled to any manufacturer’s warranty or guarantee that comes with the product.
- For consumer purchases, these warranties operate in addition to your CGA rights.
11. Force Majeure
- We are not liable for any delay or failure to perform our obligations (including delivery) where such delay/failure arises from events beyond our reasonable control (e.g., natural disasters, fires, strikes, pandemics, supply chain disruptions).
12. Disputes and Governing Law
- Any dispute or claim arising from these Terms & Conditions may be resolved by arbitration under the Arbitration Act 1996 (NZ), or another mutually agreed dispute resolution process.
- These Terms & Conditions are governed by and interpreted in accordance with New Zealand law.
13. Privacy Policy
- Collection of Information
- When you place orders or use our services, we collect personal information (e.g., name, address, contact details) to enable us to carry out our business activities.
- We may also use cookies and other tracking tools to analyse site usage and improve your experience.
- Use and Disclosure
- We may disclose your information to third parties (e.g. suppliers, courier companies, payment processors) only as necessary to fulfil your orders and provide our services.
- We do not sell or rent your personal information to unrelated third parties.
- Access and Corrections
- You have the right to access and request correction of any personal information we hold about you.
- To do so, please contact us.
- Security
- We use SSL encryption and take reasonable measures to protect your information from misuse, loss, or unauthorised access.
- We do not store full credit card details.
- Unsubscribing
- You can unsubscribe from marketing emails by using the provided link in any promotional email or contacting us.

14. Your Account
- If you create an account on our website, you are responsible for maintaining the confidentiality of your account details and password. You accept responsibility for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or modify content at our discretion.

- All content on this website, including text, images, graphics, logos, and other materials, is the property of Good Egg or its content suppliers and is protected by copyright laws.
- You may not reproduce, distribute, or use any portion of this website for commercial purposes without our written consent.
- All trademarks, images, and logos displayed on this site are the property of Good Egg or their respective owners.
- Any use of manufacturer brand names or logos is for compatibility reference only and does not imply endorsement.
- Unauthorised use of our trademarks or copyrighted materials is prohibited.
16. Reviews, Comments and Other Content
- Customers may post reviews, comments, and other content, provided they do not contain illegal, defamatory, obscene, or spam material. By posting content, you grant Good Egg a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and distribute the content in any media. We reserve the right (but not the obligation) to monitor and remove any content at our discretion.
17. Use of Testimonials
- Testimonials on this site represent individual experiences and may not be typical. We may edit testimonials for clarity while preserving their original intent. By submitting a testimonial, you agree that we may publish it unless you request otherwise. Good Egg is not responsible for user-generated testimonials or opinions.
