Terms and Conditions

General

This website (“site”) is owned and operated by Ampersand Marketing Ltd, trading as Good Egg (hereafter referred to as “the Company”, “we”, “our” or “us”).

These terms and conditions apply to all access and use of this site, and the supply of all goods sold by the Company to the Customer unless otherwise agreed in writing by the company.

Your use of this site is governed by these terms of use. By accessing and browsing this site you agree to be bound by these terms of use.

This site is intended for the use of New Zealand residents only. Good Egg NZ makes no representation that any product or service referred to on goodegg.co.nz is appropriate for use, or available, outside of New Zealand. Those who choose to access this site outside of New Zealand are responsible for compliance with local laws to the extent that local laws are applicable.

Applicable Law

These terms and conditions are governed by the laws of New Zealand. The Company and the Customer shall submit to the non-exclusive jurisdiction of the courts of New Zealand in respect of any dispute or proceeding arising out of these terms and conditions.

Copyright

Good Egg permits you to access and make personal use of this site but no portion of it may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without the express written consent of Good Egg.

Your Account

If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are accessing and using the website on someone else’s behalf, you represent that you have the authority to bind that person as a principal to all the terms and conditions provided herein, and you agree to accept liability for harm caused by any wrongful use of the website resulting from such access or use.

We reserve the right to refuse service, terminate accounts, add, remove or edit content, for any reason, in our sole discretion, without prior notice.

Site Contents, Prices, Specifications, and Policies

Although the information provided in this site is presented in good faith and believed to be correct as at the date it was submitted, we do not warrant that the content of this site is accurate, complete, reliable, current, or error-free. Good Egg will not be liable for any damage, loss, claim or expense suffered as a result of the information on this site or any linked site not being accurate or updated.

All prices are listed in New Zealand Dollars inclusive of Goods and Services Tax (GST). While Good Egg is committed to providing exceptional service, we reserve the right to update prices, specifications and policies at any time without notice. Adjustments may also be made without notice prompted by but not limited to changing market conditions, policy changes, product availability, technical malfunction, errors in advertisements and human error.

Good Egg accepts no liability should any of our goods become unavailable or if pricing and specifications differ from those shown on this website or in any advertising, quotation, pricing, invoice or acknowledgement. We will notify you if you purchased goods from us and the pricing or availability has changed.

If a product purchased from Good Egg is not as described, your sole remedy is to return the product in unused condition for a refund of the amount you paid.

No Liability

To the extent permitted by law: all warranties, representations and guarantees (whether express, implied or statutory) are excluded, including without limit, suitability, fitness for purpose, accuracy or completeness of this Site or the content on or accessed through it; and we will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with your access to or use of this Site or the content on or accessed through it.

If the New Zealand Consumer Guarantees Act 1993 applies, you may have rights or remedies which are not excluded nor limited by the above. If you are using this Site or its content for business purposes, the above exclusions and limits will apply and the New Zealand Consumer Guarantees Act 1993 will not apply. We will take action, within a reasonable time, to correct any error or inaccuracy which is brought to our attention.

Reviews, Comments, Communications, and Other Content

Visitors may post reviews, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam".

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. Good Egg NZ reserves the right (but not the obligation) to remove or edit such content.

If you do post content or submit material, and unless we indicate otherwise, you grant Good Egg NZ and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Good Egg NZ and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Good Egg NZ or its affiliates for all claims resulting from content you supply. Good Egg NZ has the right but not the obligation to monitor and edit or remove any activity or content. Good Egg NZ takes no responsibility and assumes no liability for any content posted by you or any third party.

Use of Testimonials

Testimonials that appear on this site are actually received via text, audio or video submission. They are individual experiences, reflecting real life experiences of those who have used our products and/or services in some way. They are individual results and results do vary. We do not claim that they are typical results. The testimonials are not necessarily representative of all of those who will use our products and/or services.

The testimonials displayed in any form on this site (text, audio, video or other) are reproduced verbatim, except for correction of grammatical or typing errors. Some may have been shortened. Delivery of Goods

Good Egg shall deliver the goods to the address stated on the customer order or as agreed by Good Egg in writing. Good Egg shall deliver the goods by such carrier and such form of transport Good Egg considers to be appropriate.

Delivery of the goods will be deemed to occur when the goods are delivered to the customer or customer’s premises by Good Egg or its agent at the location specified by the customer, or when the customer or any employee or agent of the customer takes possession of the goods, whichever occurs first.

Good Egg will make every effort to ensure delivery of the goods on time but will not be responsible for any part delivery or delay in delivery of the goods as a result of events occurring beyond Good Egg’s control. Good Egg will not be liable for any loss or damage, including (without limitation) consequential loss arising in any way from any delay in delivery. Good Egg reserves the right to dispatch goods in one delivery or by instalments.

The customer is responsible for paying any redelivery fees levied by carriers and agrees to pay the redelivery charges before the parcel is redelivered. If such the customer does not pay any redelivery charges, the goods will be returned and the paid order amount minus delivery and redelivery charge credited and order cancelled. Any delivery charges incurred by Good Egg will not be credited under any circumstance.

Risk and Ownership of the Goods

The customer receives risk in the goods upon delivery directly to the customer or to the address specified by the customer. Where a carrier is used to effect delivery, delivery to the carrier is the same as delivery to the customer, and all claims for goods damaged in transit should be directed to the carrier immediately after the delivery of the goods to the customer.

Until all monies paid for the contracted goods have been cleared, or where Good Egg owes monies to the customer, the goods remain the property of Good Egg.

Damage, Defects, and Loss in Transit

Complaints and claims must be made in writing to Good Egg by the Customer within thirty-six hours of delivery (for genuine OEM products) or within 12 days for third party compatible products. Failure to obtain a receipt for goods delivered shall not be proof of non-delivery, short delivery or of any defect. Good Egg has the right in its discretion in respect of any accepted claim to replace the goods or to credit the appropriate portion of the purchase price thereby fully discharging all its legal liabilities. Good Egg is not liable for any loss, direct or indirect, or consequential, attributable to defective goods except to the amount of the price for those goods as sold to the Customer. Claims for loss in transit shall be made under the Carriage of Goods Act.

Out of Stock Products & Backorders

If the customer orders a product that is later found to be out of stock Good Egg reserves the right to put the order on backorder and provide the customer with an estimated delivery time. The customer may ask Good Egg to either find and offer an alternative (similar) product (if an alternative option is available) but price differences will need to be paid by the customer if the cost is higher or refunded by Good Egg to the customer if cheaper. If the estimated delivery time is not acceptable to the customer, Good Egg will offer a full refund to the customer.

Returns and Refunds

Unless under the terms of the product warranty as stated at the time of purchase, Good Egg will not accept the return of goods for credit or any other purpose unless it agrees to accept the return of the goods and advise the Customer a return advice number prior to the return of goods. Return freight will be at Good Egg’s cost only when there has been an error on its part.

No returned goods shall be accepted by Good Egg (even if Good Egg agrees to do so) if they have been tampered with by you or any other person, if they are goods expressly sold on a non-return basis, or if they are not accompanied by the return advice number provided by Good Egg. Where goods are returned to Good Egg but not accepted as above, they shall be returned to you at your expense.

Receipt by Good Egg or by any of our agents or representatives of any goods returned other than in accordance with the above terms shall not constitute nor be deemed to constitute Good Egg’s acceptance of the return of the goods for credit or any other purpose.

A 15% or $30.00 restocking fee (whichever is the greater) may be applied to goods accepted for credit, except for third-party compatible products. Goods accepted for credit on return shall be returned free of all charges (freight, insurance, taxes and duties) and be accompanied by the relevant packing slip or invoice number and in the original (and undamaged) packaging and with all relevant manuals and in a saleable condition.

Product Guarantees and Warranties

All Good Egg products are supplied by New Zealand distributors and come with a manufacturer’s warranty that is supported within New Zealand.

Where the goods are of a kind ordinarily acquired for personal, domestic or household use or consumption in accordance with the Consumer Guarantees Act 1993 and the Consumer Guarantees Act 1993 applies:

  • if any of the goods fail to comply with any guarantee in the Consumer Guarantees Act, Good Egg will repair or replace those goods;
  • without excluding Good Egg’s obligations under the Consumer Guarantees Act 1993, the Customer acknowledges that Good Egg does not provide any Express Guarantees (as defined in that Act) other than those expressly confirmed by Good Egg in writing.

If the goods have been acquired for business purposes, the terms of the Consumer Guarantees Act 1993 shall not apply. In these circumstances the only warranty offered by Good Egg (express or implied, statutory or otherwise) is the manufacturer's warranty accompanying the goods, and in no event shall the liability for direct or consequential damages exceed the price paid for the goods.

Good Egg’s liability shall extend only to repair or replacement of goods under warranty, or refund of the purchase price, and shall not extend to any consequential damages and or loss. The company will not accept liability where, in the company’s opinion, the product has been misused or used incorrectly, static sensitive devices have been tampered with or where the product was supplied in anti-static protective packaging but not returned in such packaging.

Nothing in these terms is intended to have the effect of contracting out of the provisions of the Consumer Guarantees Act 1993 except to the extent permitted by that Act, and these terms are to be modified to the extent necessary to give effect to that intention.

Compatible (non-OEM) products guarantee

If you are not satisfied with the performance or quality of any third party compatible products purchased from Good Egg, we will supply a replacement product at no cost to you (within 12 months after the date of your purchase).

If our products are proven to have damaged your printer, we will repair, or if necessary, replace the printer with an equivalent model of the same or better specifications up to the value of $1000+GST.

We reserve the right to request evidence of faults, quality issues or damage prior to sending replacement products or authorising printer repairs. Please note that you must contact us and receive our prior written approval before contacting a service agent or repairer and prior to commencing repairs. In the event that we authorise (in writing) a repair to a printer, we will nominate a repairer of our choice.

In the unlikely event of replacing a printer, the decision will be made at our sole discretion, and we will arrange and supply the printer.
